A Judge Allegedly Asked A Rape Victim If She ‘Tried Closing Her Legs’ When She Was Raped

The victim, who is four months pregnant, was asked by the female magistrate in Spain's Basque Country if she had 'closed her legs and all female organs' during an alleged assault (stock image)

The female victim had filed a complaint against a man who she claims had raped and physically abused her several times, and requested a restraining order.

When called to give her statement, the judge ‘repeated questions to the victim on whether she made any attempt to resist aggression including asking her “did she close her legs firmly?” and “did she close all of her female organs”,’The Local reports. More after the cut…


The Clara Campoamor Association, a campaign group for victims of gender crime, is now demanding a full investigation into Judge María del Carmen Molina Mansilla and has called for her suspension. A representative from the organisation told The Local that the judge ‘showed obvious disbelief of the testimony of the victim’.

‘She questioned her without allowing her to answer, asking leading and offensive questions,’ Blanca Estrella Ruiz of the Clara Campoamor Association said.’Such questions are not only unnecessary to the investigation but are completely offensive and violate the dignity of the victim.

According to the organisation, the judge has had several complaints filed against her from female victims of alleged sexual assaults
